Which U.S. Immigration Path Fits You? A Plain-English Guide

If you are not sure where to start, you are not alone. Most people begin with a simple question: “Which path fits my situation?”

This page helps you sort that out quickly. It breaks immigration into three common buckets, answers the comparisons people search for most often, and tells you what to send in your first email so you can get a clear next step.

I’m Joe Kwon, based in Nashville. I work with immigration clients nationwide.

Quick self-check

If you are a U.S. employer, or you have a sponsoring employer

Start with Business Immigration. This usually includes PERM and EB-3 planning, H-1B, L-1, TN, and I-9 compliance support.

If your goal is through marriage, a fiancé(e) relationship, or citizenship

Start with Family Immigration. This usually includes marriage-based green cards, K-1 fiancé(e) visas, and naturalization (N-400).

If you have strong credentials, national recognition, or an investment-based goal

Start with Extraordinary Ability and Investors. This usually includes O-1, P-1, EB-1, EB-2 NIW, and EB-5.

  • The better option depends on the company structure, the employee’s history, and the role. H-1B cases focus heavily on whether the position qualifies and whether the job requirements and evidence line up cleanly. L-1 cases focus on the corporate relationship and the employee’s qualifying employment abroad, plus whether the U.S. role fits L-1A or L-1B criteria.

If you email the role title, worksite location, and timeline, I can tell you what information is needed to evaluate fit.

    Business Immigration

  • Employer sponsorship can be a practical retention tool when the job and business need support a long-term plan. PERM-based workflows are process-heavy, so planning and documentation matter early.

For a quick first review, send the role title, worksite location(s), minimum requirements, and your target timeline.

    Business Immigration

  • There is no one-size-fits-all answer. The right path depends on whether you are already married, where each person is located, and what your timeline looks like. Marriage-based processes are usually the natural fit if you are already married. K-1 can make sense when you plan to marry after entry and that timing fits your situation.

Email your locations, current status (if any), and timeline and I will tell you what to gather to assess next steps.

    Family Immigration

  • Timing depends on eligibility, travel history, and anything that needs careful review such as prior filings or record issues. Many applications are straightforward, but accuracy matters.

If you email your status history and travel range, I can send a focused checklist.

    Family Immigration

  • These options can overlap, but they are built differently. The best fit depends on your recognition record, the nature of your work, and your long-term goals. A practical first step is to send your CV or resume and a short list of your strongest highlights.

    Extraordinary Ability and Investors

  • Both are EB-5 structures. The better fit depends on your timeline, general investment plan, and documentation needs. If you email your timeline and whether you are leaning regional center or direct, I can tell you what information is needed for a proper evaluation.
